The judiciary in South Africa is increasingly coming under public attack by influential members of the ruling African National Congress (ANC).

This is concerning for justice and the rule of law, especially given the deep leadership challenges that now face the police and prosecution service.

The powerful Secretary General of the ANC Gwede Mantashe has repeatedly stated that certain courts are ‘biased’ against the ruling party. South African Communist Party, an alliance partner of the ANC deputy secretary Solly Mapaila stated that his party would hold a special congress next month to draw up a detailed plan to tackle the judiciary.

How should these attempts to weaken the credibility of the judiciary be understood? What are the likely reasons for these sentiments and what are the possible consequences?

Le système judiciaire sud-africain en ligne de mire

La multiplication des attaques contre le système judiciaire sud-africain par les membres du Congrès national africain (ANC) au pouvoir représente un danger pour la justice et l’État de droit, notamment en raison des problèmes de leadership actuels au sein des services de police et du parquet.

Le puissant Secrétaire général de l’ANC, Gwede Mantashe, a affirmé à plusieurs reprises que certains tribunaux étaient contre le parti. Le ministre de la Police, Nathi Nhleko, aurait déclaré à des responsables gouvernementaux en mars dernier que plusieurs juges étaient corrompus, ajoutant que cette tendance était à la hausse.
